Terms and Conditions

Please read these Terms and Conditions (“Agreement”) carefully before making any reservations, purchasing tours, or using any services offered by U.S Open Tours (“we,” “us,” or “our”).

By accessing or using our services, you agree to be bound by these Terms and Conditions to the extent permitted by applicable law.

 

A. General Terms and Conditions

1. Client Agreement and Eligibility

Eligibility
You must be at least 18 years old to use our services. Individuals under 18 may only use our services under the supervision of a parent or legal guardian.

Client Responsibility

Prior to Booking: You are responsible for reviewing all relevant information, including pricing, itinerary, inclusions/exclusions, and cancellation policies before making a reservation.

Post-Booking: You must ensure your contact information remains accurate and up to date.

Compliance: You agree to comply with all applicable laws and regulations of the destinations you visit, including immigration and customs requirements.

Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the Socialist Republic of Vietnam. However, if you are a resident of the United States, applicable consumer protection laws of your state may also apply.
Any disputes shall be resolved through arbitration in Ho Chi Minh City, Vietnam, unless otherwise required by applicable law.

2. Our Role and Limitation of Liability

Agency Status
U.S Open Tours acts as an intermediary facilitating travel services provided by independent third-party suppliers, including tour operators, hotels, and transportation providers.

Information Accuracy Disclaimer
We strive to ensure accuracy but do not guarantee that all website content is error-free or up to date. Changes may occur without prior notice.

Third-Party Liability
To the fullest extent permitted by law, U.S Open Tours shall not be liable for any loss, injury, delay, or damage resulting from acts or omissions of third-party providers.

Limitation of Liability
To the maximum extent permitted by law, our total liability shall not exceed the amount paid by you for the relevant booking.

Force Majeure
We are not liable for delays, changes, or cancellations caused by events beyond our control, including but not limited to natural disasters, pandemics, government actions, or transportation disruptions.

Baggage and Personal Belongings
All personal belongings are carried at your own risk. Travel insurance is strongly recommended

3. Reservation and Purchase Details

    Pricing
    All prices are in USD and subject to availability and change.

    Reservation Process

    A confirmation email receipt does not guarantee availability.

    Booking status will be confirmed within 1–2 business days.

    An E-Ticket will be issued once confirmed.

    Travel Documentation
    You are responsible for obtaining valid passports, visas, and any required travel documents.

    Airport Transfers
    Flight details must be provided in advance. Failure to do so may result in loss of transfer services.

    4. Tour Operations and Changes

    Tour providers may modify or cancel itineraries due to safety, operational, or external factors.

    If comparable services are provided, no refund shall be issued except where required by applicable law.

    Tours may operate in multiple languages depending on availability.

    5. Special Travel Conditions

    Medical Conditions and Pregnancy
    You are responsible for assessing your fitness to travel and consulting a medical professional if necessary. Participation may be restricted based on safety considerations.

    Special Needs
    You must inform us of any special requirements prior to booking. Availability of accommodations cannot be guaranteed.

    Group Bookings
    Group members are responsible for internal arrangements. Changes may incur additional costs.

    6. Chargebacks and Disputes

    You agree to contact U.S Open Tours at uv.booking@usopentours.com to resolve any issues before initiating a chargeback. Improper chargebacks may be subject to recovery actions where permitted by law.

    7. Data Privacy and Communication

    Your use of our services is also governed by our Privacy Policy.

    By providing your contact information, you consent to receive service-related communications and promotional messages (you may opt out at any time).

    B. Amendment and Cancellation Policy

     

    This policy applies unless otherwise specified in the tour details.

    1. Booking Confirmation

    Reservations are not guaranteed until confirmed.

    Full refunds will be issued if booking cannot be confirmed.

    2. Amendments 

    Changes to bookings may incur fees starting from USD $30 per change, depending on timing and availability.

    3. Cancellation Policy (Multi-Day Tours)  

    20+ days before departure: Full refund

    10–19 days: 50% refund

    ≤9 days or no-show: No refund

    (All refunds subject to applicable law)

    4. Special Cancellation Rules

    Single-day tours may be canceled for a full refund if requested at least 7 days in advance (unless otherwise stated).

    5. Non-Refundable Items    

    The following are non-refundable except where required by law:

    No-shows

    Unused portions of tours

    Airfare (if included)

    Instant confirmation products

    6. Refund Process

    All cancellation requests must be submitted in writing to:

    Processing time: 1–7 business days.

    Refund method may vary depending on original payment method.

    C. Payment, Custom Bookings, and Disclosures

    1. Payment Methods and Verification

    We accept major credit cards, PayPal, wire transfer, and other approved methods.

    Verification documents may be required for fraud prevention, including but not limited to identify verification and proof of payment authorization. Failure to provide required documentation may result in cancellation of the booking.

    2. Custom Bookings (Private Tours)

    Deposit: $300 per person (non-refundable).

    Changes and cancellations are subject to applicable fees.

    Full terms apply as outlined in booking confirmation.

    3. Tour Inclusions and Exclusions

    Tour Price Includes:

    Transportation

    Hotel accommodations

    Tour guide services

    Tour Price Excludes:

    Meals (unless otherwise stated)

    Airfare

    Attraction tickets

    Personal expenses

    Service fee (USD $15 per person per day)

    4. Claims and Complaints

    Claims must be submitted within 30 days after tour completion.

    You acknowledge that travel involves inherent risks and agree to assume responsibility for such risks.

    5. Assumption of Risk

    You acknowledge that travel involves inherent risks and agree to assume responsibility for such risks.

    6. Indemnification

    You agree to indemnify and hold harmless U.S Open Tours from any claims arising from your use of our services or violation of these Terms.

    7. International Conventions

    Travel services may be subject to international treaties that limit the liability of service providers.

    8. Errors and Omissions

    We reserve the right to correct pricing or content errors and adjust bookings accordingly.

    9. Severability and Entire Agreement

    If any provision is found invalid, the remaining provisions shall remain in full force.

    These Terms constitute the entire agreement between you and U.S Open Tours.

    D. Intellectual Property

     

    1. Ownership

      All website content, trademarks, and materials are owned by U.S Open Tours / Global Holiday Tour or its licensors and are protected by applicable laws.

      You may use the website for personal, non-commercial purposes only.

      2. Copyright, and DMCA Compliance 

      U.S Open Tours complies with the Digital Millennium Copyright Act (DMCA) for content accessible in the United States.
